Definitions

“Customer” or “member” is anyone who has purchased a pre-recorded instruction module, and therefore has access to all of MAXimatician.com’s other services, not including personal interactive tutoring.

“Client/student” is anyone who has contracted MAXimatician.com for the personal interactive tutoring sessions, noting that client and student may not be the same person (if not, the client will contract for only one student per session). Commitment to the minimal hours of instruction allows the client/student to be a member as well, with access to the other services on the site.

Terms

Thank you for using the products and services (“Services”) from MAXimatician.com. By using our Services, you are agreeing to the following Terms, with an effective date of Jan. 7, 2016.

By purchasing a pre-recorded instruction module, the customer becomes a member of the site, with access to the supplemental instruction videos. There is no refund on the purchase of the pre-recorded instruction modules. These modules will be occasionally updated, and the customer/member will continue to have access to them, as well as all the supplemental instruction videos being added to the Lesson Archive.

The client/student will be bound by the Contract for Tutoring Services agreement signed prior to any instruction services. This may include a commitment to a minimum number of hours instruction, partial payment in advance of instruction, and no refund of payment for services rendered. Failure of the student to make a scheduled tutoring session (without prior notice) could result in a penalty in order to re-schedule; failure to make a second scheduled session at any time thereafter during the contract period could result in a forfeiture of payment for that session.

Please don’t misuse our Services, or interfere with our Services, or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law and applicable regulations.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. Other than for your own personal instruction purposes, you may not use content from our Services unless you obtain permission from MAXmatician.com. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.

Termination

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the service. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are suspecting misconduct.

Links other web sites

Our Service may contain links to third ­party web sites or services that are not owned or controlled by MAXimatician.com. We have no control over, and assume no responsibility or liability for any damage caused or alleged to be caused by the use of content or services available through any other website or service.

Enforcement

Our failure to enforce any right or provision of these Terms will not be considered a waiver of these rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Revisions

We reserve the right to modify these terms at any time. Any revisions will be reflected by the published effective date shown in these Terms.
